Terms of Service

1. Acceptance of Terms

By accessing or using the Joblee mobile application and website (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

Joblee (Pty) Ltd ("Joblee", "we", "us") reserves the right to update these Terms at any time. We will notify you of material changes via the app or email. Continued use constitutes acceptance.

2. Eligibility

  • You must be at least 18 years old to use Joblee.
  • You must be a legal resident of South Africa or have the right to work in South Africa.
  • You must provide accurate, complete, and current information when registering.

3. The Joblee Platform

Joblee is a marketplace that connects employers with independent workers. We are not an employer, employment agency, or contractor. Workers on Joblee operate as independent service providers.

Joblee facilitates matching, communication, and payment between parties but does not control, direct, or supervise the work performed.

4. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You may not share your account or let anyone else access it.
  • You must notify us immediately at support@joblee.co.za if you suspect unauthorised access.
  • We may suspend or terminate accounts that violate these Terms.

5. For Workers

  • Workers must complete identity verification and a criminal background check before being listed on the platform.
  • You agree to perform services to a reasonable professional standard.
  • You are responsible for your own tax obligations, including registration with SARS if applicable.
  • Applying to jobs is always free with no limits.
  • A 15% platform fee is automatically deducted from each completed job payment. This covers matching, escrow, and platform maintenance.

6. For Employers

  • Requesting help and getting matched with workers is always free.
  • You agree to pay for services upon confirming job completion through the app.
  • You must treat workers with respect and provide a safe working environment.
  • Cancellations within 2 hours of a confirmed booking may incur a cancellation fee.

7. Payments and Escrow

All payments on Joblee are processed through our secure escrow system:

  1. The employer pays the quoted amount when confirming a worker.
  2. Funds are held in escrow by Joblee until the employer confirms the job is complete.
  3. Once confirmed, the worker receives payment minus the 15% platform fee.
  4. If a dispute arises, funds remain in escrow until resolution.

Joblee uses PCI-compliant third-party payment processors. We never store your full card details.

8. Ratings and Reviews

Both workers and employers may rate and review each other after a completed job. Reviews must be honest, relevant, and respectful. We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms.

9. Prohibited Conduct

You may not:

  • Use the Platform for any unlawful purpose.
  • Harass, threaten, or discriminate against other users.
  • Circumvent the payment system by arranging off-platform payments.
  • Create fake accounts or misrepresent your identity.
  • Scrape, copy, or reverse-engineer any part of the Platform.
  • Post false, misleading, or defamatory content.

10. Disputes Between Users

If a dispute arises between a worker and employer, Joblee will attempt to mediate in good faith. Either party may escalate by contacting support@joblee.co.za. Joblee's decision on escrow release during disputes is final.

11. Limitation of Liability

Joblee acts solely as a platform facilitator. To the maximum extent permitted by South African law:

  • We are not liable for the quality, safety, or legality of work performed.
  • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform.
  • Our total liability is limited to the amount of fees you have paid to Joblee in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Joblee harmless from any claims, losses, or damages arising from your use of the Platform, your violation of these Terms, or your interaction with other users.

13. Intellectual Property

All content, trademarks, logos, and software on the Platform are owned by Joblee (Pty) Ltd. You may not use, reproduce, or distribute any Joblee intellectual property without written permission.

14. Termination

You may delete your account at any time through the app. Joblee may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason with 14 days' notice. Outstanding payments will be processed before account closure.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
